Terms of Service

1. Acceptance

By accessing SoHereAreTheFrigginFish ("the Site"), you agree to these Terms of Service. If you do not agree, do not use the Site.

2. What we provide

The Site provides fishing charts, maps, tide information, gear suggestions, and related information for the coast of Maine. All content is provided for entertainment and informational purposes only. Nothing on the Site is a substitute for official navigation charts (NOAA), current fishing regulations (Maine DMR, NOAA HMS, ASMFC), or professional maritime safety guidance.

3. Subscription, one-time purchases, and tips

  • Access is offered as a monthly subscription ($1/mo), an annual subscription ($10/yr), a one-time Lifetime purchase ($50), and a First Mate premium subscription ($5/mo).
  • Subscriptions automatically renew at the stated cadence and price until you cancel.
  • You may cancel at any time via "Manage sub" in the site header. Cancellation takes effect at the end of the current billing period; you retain access until then.
  • The Lifetime purchase grants access for the operational life of the Site; it is not a guarantee of any specific duration and is non-transferable.
  • Tips ("Rod & Tips") are voluntary gratuities. Tips are final and non-refundable and confer no additional rights, service, or access.
  • Payments are processed by our third-party payment processor. We do not store or see full card numbers.

4. All transactions are final — no refunds

ALL PAYMENTS AND CHARGES ARE FINAL AND NON-REFUNDABLE. We do not offer refunds for any reason, including but not limited to: partial-month cancellations, forgotten renewals, inability to catch fish, dissatisfaction with information provided, change of mind, weather, or any interruption of Site access. If you wish to stop being charged, cancel your subscription before the next billing date.

5. Invite codes and comp access

The Site owner may grant free access via invite codes or comp accounts. These grants are provided at the sole discretion of the owner and may be revoked at any time without notice.

6. Acceptable use

You agree not to (a) share your account with others; (b) attempt to scrape, mirror, or redistribute the Site's content; (c) interfere with the Site's operation; or (d) use the Site for any unlawful purpose.

7. No guarantee — you fish at your own risk

THE SITE DOES NOT GUARANTEE ANY CATCH, CATCH RATE, SAFE ARRIVAL, OR FITNESS FOR ANY PURPOSE. Fishing and boating are inherently dangerous activities. You are solely responsible for your safety, your equipment, your compliance with all applicable laws and regulations, and the accuracy of any conditions you observe in the field. Verify regulations, licenses, size and bag limits, closures, and safety conditions through official government sources before every trip.

8. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE OWNER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES ARISING FROM YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, OR LOST FISHING OPPORTUNITIES. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID THE SITE IN THE PRIOR THREE MONTHS.

10. Indemnification

You agree to indemnify and hold harmless the Site owner from any claims, damages, or expenses arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

11. Termination

We may suspend or terminate your access at any time, with or without cause or notice. Your obligations under Sections 4, 7, 8, 9, and 10 survive termination.

12. Changes

We may update these Terms at any time. Continued use after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Maine, USA. Any disputes shall be brought exclusively in the state or federal courts located in Cumberland County, Maine.

14. AI assistant disclaimer

The "Ask the Captain" AI chat helper is a support tool that may be incorrect. Do not rely on it for regulations, safety, or navigation decisions. Verify all information through official sources.
